The Unified Procedure for Infringement Establishment and Settlement Submissions

ODI Partner Tine Mišic and Associate Samo Miklič have co-authored an article in the European Competition and Regulatory Law Review (CoRe) titled “The Unified Procedure for Infringement Establishment and Settlement Submissions: Two Important Novelties to the Slovene Competition Legislation and Their Intertwining in Practice.”

The article explores how Slovenia's recent amendment to its Competition Act (ZPOmK-2) aligns with EU Directive 2019/1, particularly in enhancing the effective enforcement of Articles 101 and 102 TFEU. Among the key innovations introduced by the ZPOmK-2 is the unified procedure for establishing competition law infringements—an essential addition to the Slovene legal framework.

The article also highlights the success of another important mechanism introduced by the reform: the settlement submission system. This system has already demonstrated significant effectiveness in applying Articles 101 and 102 TFEU. By analysing the first two practical applications of the innovations in Slovenia —the Veterinary Chamber and Car Dealerships cases—and comparing them to other EU practices, the authors provide insight in the potential long-term implications of these legislative changes on competition law enforcement in Slovenia.
